CFTC Scrutinizes Mention Markets Amid Manipulation Concerns

The Commodity Futures Trading Commission has launched an inquiry into "mention markets," where traders wager on whether public figures will utter specific words. Regulators are questioning whether these contracts are inherently susceptible to manipulation, prompting Kalshi to suspend its sports-related word bets while maintaining other political and corporate listings.

Under the Commodity Exchange Act, designated contract markets must ensure their products are not easily manipulated. The core issue lies in the nature of the contracts: unlike sports bets based on aggregate performance, a mention market’s outcome can be determined by a single individual—a broadcaster, executive, or politician—who decides whether to say a specific word. This concentrated influence creates a high-risk environment for insider activity.

Suspicion intensified following a case involving Gabriel Perez, a former teleprompter operator for President Donald Trump. Kalshi identified and flagged suspicious trades linked to Perez, who allegedly held advance access to presidential remarks and generated over $90,000 in potential profits. The White House subsequently removed Perez from his role, and the incident serves as a primary example of the vulnerabilities regulators are now investigating. Former Representative George Santos also recently faced penalties for manipulative trades on the platform regarding his attendance at the State of the Union.

While Kalshi has pulled sports-focused mention markets indefinitely, it continues to offer contracts tied to political events and corporate earnings calls. The company has already implemented employer disclosures for high-risk categories and claims to have blocked over 100 potential insider trades this year. Whether the CFTC will demand a total overhaul of word-based betting or allow modified versions to persist remains the central uncertainty for the exchange.
