Bitcoin recovery faces reality check as legislative path narrows

Bitcoin climbed back above $78,000 following US midterm elections, as markets shrugged off an initial selloff. While traders view the result as a relief rally, the shift toward a Democratic-controlled Congress signals a cooling period for crypto-specific legislation, leaving macroeconomic data to dictate the asset's next sustained move.

Bitcoin recovery faces reality check as legislative path narrows

The overnight market rebound saw Bitcoin recover to approximately $78,300, retracing losses from an election-night dip to $75,600. Trading activity surged in derivatives markets, with Talos reporting $848 million in volume across Hyperliquid’s equity index perpetual futures—roughly 81 times the volume seen on tokenized spot venues. This shift suggests that investors prioritized perpetual futures to hedge or gain exposure while traditional cash exchanges remained closed.

Despite the price recovery, industry analysts warn that political headwinds are intensifying. James Butterfill of CoinShares notes that the CLARITY Act and other regulatory priorities now face a more difficult path through a split legislature. While Bitcoin remains insulated due to its established investment products, exchanges and token issuers may encounter heightened uncertainty. Analysts emphasize that the market should not mistake an initial relief rally for a confirmed trend, as institutional outflows persist and historical data shows November performance can remain volatile following a negative October.
